Clause 1 confirms that any arbitration shall be conducted in accordance with the JCT 2016 edition of the Construction Industry Model Arbitration Rules (CIAR) or where amended by a joint notice to the arbitrator stating that they wish the arbitration to be conducted in accordance with the rules as so amended. 

Notice of reference to arbitration

Clause 2.1 to 2.2.3 sets out the notice requirements, 'the notice of arbitration'. The parties have the option to agree on the appointment of an individual arbitrator or seek appointment by the appointing body referred to in the contract.

Powers of arbitrator

Clause 3 sets out the powers of the arbitrator.

Effect of award

Clause 4 confirms that the award shall be final and binding on the parties.

Appeal - questions of law

Clauses 5. 1 to 5.2 confirms the application of the Arbitration Act 1996 in respect of any question of law arising in the course of the reference and arising out of an award made under this arbitration agreement.
