Summary of changes in the 2011 editions

The 2011 edition of the IBC introduces the following changes:

  • New payment provisions (in section 4 of the conditions) to reflect changes introduced by the 2009 Act;
  • Changes to insurance provisions (in section 6) in order to introduce revised terrorism cover clauses;
  • Revised retention provisions in the sub-contracts;
  • Other minor changes:
    • modifications to the to the way in which notification of certificates issued under the contract is to be given to the parties;
    • the appointment of the principal contractor under CDM regulations has been extended to cover that function under the Site Waste Management Plans regulations 2008;
    • statutory reference to the new Bribery Act 2010; and
    • revised insolvency definition in the termination section.

The IBC/CD introduces the following changes, in addition to those set out above:

  • amendments to the insurance provisions (in section 6) in order to remove asbestos and fungal mould claims from the list of default insured risks covered by the professional indemnity insurance that the contractor is required to take out in respect of the contractor’s designed portion.
