Overview

Documentation is key to maximising value and rental income and ensuring a smooth transaction. Documentation should be in place to demonstrate the following:

  • the site condition has been adequately assessed by an environmental assessment or review (commonly known as an Environmental Audit or Phase I) and/or an intrusive site investigation (Phase II) and there are no significant information gaps;
  • where contamination has been identified, it does not represent a risk to the existing or proposed use of the site;
  • contamination is not migrating off the site within groundwater;
  • contamination does not represent a significant risk to groundwater and surface water resources;
  • contamination does not represent a risk of regulatory authority action;
  • contamination does not represent a risk of third party action (e.g. from adjoining land owners).
